* Recordation by rights owners
 

Copyright holders or trade mark owners who find their rights being infringed may use the standard Recordation Forms to apply for recordation of their works or products.

Please read the following guidelines on the recordation requirements and procedures before completing the forms.
   
* Application for IPR recordation
  Requirements
 
1) The Applicant should be:
 
a) the trade mark owner or his/her authorized representative; or
b) the copyright holder or his/her authorized representative.
2) Proof of ownership:
 
a) Information on the trade mark registration in Hong Kong (a trade mark may be registered in accordance the Trade Marks Ordinance, Chapter 43, Laws of Hong Kong); or
b) Affidavit for a copyright work (original affidavit should be produced on demand).
3) The alleged infringing activity takes place within the territory of the Hong Kong Special Administrative Region.
4) An examiner is appointed by the rights owner to conduct seizure identification and testify in a court of the Hong Kong Special Administrative Region.

Procedure
If the above requirements are met, the Applicant should complete the relevant form (Form 1 or Form 2) and send it to the Customs and Excise Department by fax (Number : (852)-2543-4942) or email (Address: customsenquiry@customs.gov.hk).
